Terms of Service

1. Acceptance

By creating a Way2Chat account or embedding our widget, you agree to these Terms. If you're accepting on behalf of an organisation, you confirm you have authority to do so.

2. The service

Way2Chat provides a live chat platform including a dashboard, embeddable widget, REST API, and mobile agent app. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. Your account

You are responsible for keeping your login credentials secure. You must not share your account or API keys with unauthorised parties. Notify us immediately at admin@way2chat.com if you suspect unauthorised access.

4. Acceptable use

You may not use Way2Chat to:

• Send spam, unsolicited messages, or deceptive communications
• Collect sensitive personal data without proper consent (health, financial, password data)
• Impersonate a support agent from a company you don't represent
• Violate any applicable law, including data protection law in your jurisdiction
• Reverse-engineer, scrape, or attempt to extract our source code or data
• Abuse or overload the infrastructure (automated flooding, DoS attacks)

5. Your data

You retain full ownership of your conversation data and any content uploaded through the platform. By using the service, you grant us a limited licence to store and process that data solely to operate the service on your behalf.

6. Plans and billing

Free plan features are provided as-is with no uptime guarantee. Paid plans are billed monthly. Cancellation stops future billing; no pro-rata refund is issued for the current billing period unless explicitly offered in a promotion.

We may change plan pricing with 30 days' written notice. Existing subscribers on annual plans are not affected until renewal.

7. Intellectual property

The Way2Chat platform, including its source code, design, and trademarks, is our intellectual property. You receive a limited, non-exclusive, non-transferable licence to use the service. You may not resell, sublicense, or white-label the platform without a separate written agreement.

8. Disclaimer of warranties

The service is provided "as is" without warranties of any kind. We do not guarantee 100% uptime, error-free operation, or fitness for a particular purpose. Use at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from use of the service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the platform operator is registered. Disputes shall be resolved in the courts of that jurisdiction.

11. Changes

We may update these Terms. Material changes will be communicated by email at least 14 days before they take effect. Continued use constitutes acceptance.
